Since you have not replied within the required timeframe, this appeal is now closed and rejected based on the available evidence.
Your account was suspended for the unauthorised redistribution of Eggy products through third-party websites.
On 20 September, Eggy implemented an upgraded security system that allows redistributed product packages to be matched to the Eggy account from which the identified copy originated. This system is designed to identify the originating account associated with a package and does not attempt to determine who may subsequently have uploaded, transferred or further distributed that package.
In this case, the redistributed copy of Velqeris Ultra 1.0.4 was fingerprinted to the Eggy account "jibon". The same product was identified on a third-party website on 21 September, one day after the relevant activity associated with your account.
Further review also identified additional activity consistent with previous unauthorised redistribution involving the same third-party website. Some of this broader activity only became attributable after the upgraded security system was introduced.
All relevant evidence supporting this decision will be included with this post.
Under Eggy terms and rules, the unauthorised redistribution, sharing, publication or provision of Eggy products through third-party websites or services is prohibited.
Enforcement in redistribution cases is based on the originating Eggy account associated with the identified package. Responsibility for copies issued through an account remains with the account holder, regardless of whether that account holder personally uploaded the package to the third-party website or passed it to another person beforehand.
The decision was made following a review of the available evidence as a whole, including account activity, product access and download history, IP access records, timing, third-party activity and package fingerprinting. Eggy does not rely on a single unrelated indicator when making enforcement decisions of this nature.
The fingerprint associated with the redistributed package has been matched to your account. Your permanent suspension is therefore upheld and this decision is final.
Eggy does not provide any further appeal process for piracy or unauthorised redistribution cases where the originating account has been confirmed through package fingerprinting and supporting evidence.
Please do not create, operate or use additional accounts for the purpose of regaining access to Eggy services or products. Any additional accounts reasonably identified as being operated by or on your behalf may also be suspended in accordance with Eggy terms and rules.
Eggy does not impose permanent suspensions lightly. Such action is taken where, following review of the available evidence, continued access is considered to present an unacceptable risk to Eggy, its products or its licensing arrangements.
